Tickle v Giggle appeal decision, Sall Grover, transgender discrimination Australia — the Full Federal Court handed down its ruling last Friday and it’s an absolute disaster. Three judges not only upheld the original decision that Sall Grover’s women-only app Giggle for Girls unlawfully discriminated against transgender woman Roxanne Tickle — they upgraded it from indirect to direct discrimination and doubled the damages to $20,000.
Grover responded saying “I am absolutely devastated. Men who claim to be women have more rights than actual women in Australia.” She has announced she intends to take it to the High Court.
For those who don’t know the backstory — Sall Grover built an app for women. A facial recognition system flagged Tickle as male and removed the account. Tickle sued. Australia’s Sex Discrimination Act, which doesn’t actually define man or woman anywhere in it, meant the courts ruled sex is mutable under Australian law. The same woman who got sued for excluding a trans woman then bought a ticket to an International Women’s Day event — for and by trans women only — and got excluded.
Meanwhile, the IOC has banned trans women from the Olympics. The United Kingdom Supreme Court ruled the legal definition of woman is based on biological sex. The United States has gone the same way. And Australia has three Federal Court judges going in the opposite direction.
Grover says she will challenge this in the High Court.
