Twitter Gets Served

Fresh off a battle with The New York Times, Project Veritas’ James O’Keefe has set his sights on Twitter. O’Keefe is suing the social media giant for defamation, claiming they permanently suspended his account because he operated fake accounts.

O’Keefe contends nothing is more important than a journalist’s reputation and that Twitter deliberately defamed him by their actions. Viva Frei’s David Freiheit opines that the lawsuit is a well-drafted, well-reasoned and succinctly put, which he thinks will lead Twitter to seek cover under Section 230 Communications Decency Act, claiming it is just a platform enacting its policies. Teflon Hunter Untouchable

David Freiheit and Robert Barnes take a more comprehensive look at the latest crime spree by Hunter Biden, the Teflon son of President Biden. Hunter’s transgressions have been well-documented over the years yet he’s never seen the inside of a jail cell, again suggesting a two-tiered system of justice in America.

But lo and behold, there’s more crimes that Hunter’s been allowed to commit with impunity and immunity and, this time, says Barnes, it implicates the Secret Service and key Trump Administration officials who covered it up and hid it from President Trump himself. The crime in question is the unlawful purchase and disposal of a firearm by Hunter, which sidestepped the law on many levels. Project Veritas Gets Huge Win

In a major victory for the good guys, the New York Supreme Court ruled that Project Veritas can continue with its defamation lawsuit against The New York Times, after tossing a motion to dismiss by the newspaper. The suit was brought against The Times after it published five articles blasting a Project Veritas video relating to improprieties of ballot harvesting in Minneapolis as fake news.

The Times filed a motion to dismiss on two basis–one was the standard failure to state a claim and the other was a invoking SLAP (Strategic Lawsuit Against Public Participation) legislation. It is an unfortunate, but unknown reality of litigation that SLAP lawsuits are basically a method for rich clients to silence their critics. They Won’t Leave Flynn Alone!

The Deep State is obsessed with Michael Flynn and will not leave him alone. First it was the Mueller investigation, followed by the years of the Flynn judicial saga. Now the Army is reviewing its investigation to determine if there were violations of the emolument’s clause.

Viva Frei’s David Freiheit reports that the investigation involves Flynn’s acceptance of money from Russian and Turkish interests before joining the Trump Administration. The probe was initiated by the Inspector General in 2017 but put on hold for three years in light of the Judicial Department’s investigation. Tune in, as Freiheit digs deeper into the specifics.

Judging The Jury

The most difficult–and almost impossible–part of seating an impartial jury for the Derek Chauvin murder case will be selecting someone who doesn’t have any basic knowledge of the case.

The alleged murder of George Floyd by Minneapolis police officer Chauvin was front and center on all media for weeks. So finding a juror who has no knowledge of the case, or claims as much, presents its own problems. The reality is, says Viva Frei’s David Freiheit, is finding someone who doesn’t have a foregone conclusion of the case and is open to being convinced by the evidence at trial. Freiheit explains more of the jury selection process, including the sometimes complicated questionnaire and the all-important pre-emptory challenge, which means either side can strike any juror for any reason or no reason whatsoever.

Agents Of Disinformation

A hasty tweet by the Southern Poverty Law Center has sent Viva Frei host David Freiheit into a frenzy. The tweet says: “Loaded guns, zip ties, threats, several injuries & five murders. But ask @senronjohnson about the violent Jan. 6 insurrection at the U.S. Capitol and he won’t call it for what it was. #YearInHate #RefuseHate.

Freiheit  was apparently taken aback by the post, proceeded to read the fact check on the tweet from Politifact and was compelled to respond, calling out the Southern Poverty Law Center for spreading misinformation. The law center discreetly retweeted the post, changing “loaded weapons” to “weapons” and “5 murders” to “5 related deaths.” They did this, Freiheit says, without so much as an apology, a correction or a formal retraction. He shot right back with: “Barring an apology and a correction, quietly deleting a tweet and pretending it didn’t happen, just adds further dishonesty to the initial dishonesty.”

Still not pleased by the law center’s second tweet, Freiheit decided to look into the five deaths and came up with some interesting conclusions. Here’s more from Viva Frei.

Judge Thomas’ Masterpiece

Viva Frei’s David Freiheit takes a crack at deciphering the Supreme Court’s decision to deny the petition for certiorari in the Pennsylvania election fraud lawsuit. Simply put, the question of law in this case is whether the Pennsylvania Legislature’s action to modify certain election rules was lawful. In a searing, 10-page dissenting masterpiece, Justice Clarence Thomas admonished his colleagues.

SCOTUS voted 6-3 to deny the petition, explaining there were too few votes to make a difference in the outcome of the election. Thomas argued in his dissent that is a scenario that could be repeated in future elections and the court’s refusal to take the case is inexplicable. Here’s more with Viva Frei.

University Snubs Trump Lawyer

The cancel culture is alive and thriving. A university cancelled a teaching gig at its law school for David Schoen, one of President Trump’s attorneys, because of his involvement in the recent second impeachment trial. Schoen was told that some faculty and students at the university said they would be uncomfortable with him being on campus because of his defense of Trump. In a recent interview with Newsmax, Schoen stopped short of naming the school.

It sends a terrible message to law students. “If someone wants to be a lawyer and they’re going to be uncomfortable with someone being on campus because of their beliefs, find a new thing to do in life,” says Viva Frei’s David Freiheit. “That type of childishness might fly on campus, but it will not fly in the practice of law and it certainly will not fly in the courtroom.” Here’s more on Viva Frei.

No Science In Lockdowns

It’s become increasingly obvious that we don’t follow the science when it comes to lockdowns. In some areas, there are more cases of COVID-19 now than when lockdowns were enforced. What it sadly comes down to is political expediency, because we actually don’t know if lockdowns work. They’re different in every country and, truth is, we haven’t really defined it, haven’t studied it and haven’t measured it.

“Follow the science has become a euphemism for follow the leader, do what you’re told and don’t question it,” says David Freiheit of Viva Frei. So, Frei says, are we really using this euphemism to divide people and see who cooperates and who doesn’t? Freiheit was among a panel of experts on The Rubin Report with Dave Rubin, joining Dr. Drew Pinsky and Dr. Zubin Damania.

Interestingly, there’s actually a well-hidden history of lockdowns in the United States. In a story that was documented in The New York Times, a 14-year-old science student in Albuquerque, N.M., built a computer model to reduce the spread of influenza. She determined that you could close down local schools and reduce the spread. Her father, a computer programmer at Los Alamos National Laboratory, took it a step further and said he could actually use the idea to build a model for regional lockdowns in a pandemic. Surprisingly, the George W. Bush Administration adopted the model as policy. Dr. Pinsky says the model is absent from textbooks and science papers and it wasn’t until the Chinese Communist Party actually implemented the model that it was something no one thought they would ever do.

Mouthy Maxine’s Insane Drivel

Every once in a while you read a headline that’s so insane, ludicrous and preposterous, you automatically think fake news. Well, it was showtime recently, starring Big Mouth Maxine Waters.

The Congresswoman launched a hyperbolic rant against President Trump, suggesting that he should face charges for premeditated murder on the basis that the speech he gave on Capitol Hill led to the riot and the eventual deaths of two people. For any of you who believe in the absurdity of this claim, Viva Frei’s David Freiheit explains from a legal perspective.
