Trump’s Legal Path To Victory

Florida Congressman Matt Gaetz says there still is a legal and lawful means by which President Trump and his legal team could turn around election results in key states that were originally projected for Joe Biden.

At the moment, the number of states that have certified their electors favors Biden reaching 270 votes and the Presidency. But not so fast, Gaetz says. He tells Newsmax anchor Sean Spicer that he has spoken with key Republican members of the House and Senate and there is interest in the alleged voting irregularities, and in presenting them to force a debate in Congress about whether to accept these electors. Each of the electors are subject to objection as spelled out in the Constitution.

Are Former Felons Still Citizens?

Federal agents raided rapper Lil Wayne’s plane at Miami Opa Locka Airport, finding a gold-plated gun and some ammo, according to TMZ. Born Dwayne Carter, the popular performer now faces 10 years in prison because of a 2009 felony conviction, which meant he lost his Second Amendment protections forever.

We used to say that a court sentence was how a man pays his debt to society. Now, a man can never pay that debt. So are we no longer the land of second chances? “Right Angle” panel member Scott Ott says, “Call me a 2nd Amendment purist, but I don’t think it should be illegal to own a gun. If I’m not in the penitentiary and I own a gun, that should not be illegal. I’m going to go even further on this. Not only do I not feel we should refer to somebody who has paid their debt to society as a felon, or even as a former felon, I don’t think it should be on a record that anybody can access.”

Legal Suits May Spark Violence

President Trump’s legal challenge of the 2020 election appears to be hanging on the outcome of the vote in Georgia, Michigan and Pennsylvania, both at the ballot boxes and courts.

Team Trump filed suit in the Pennsylvania Commonwealth Court, asking for a stay on the vote until ballots filed after election day are tossed. In addition, Team Trump’s suit in Alleghany County, Pa., charges that the Republican Party was blocked from observing the vote. In Michigan, there is a suit in Wayne County, home to the state’s largest city of Detroit, which harbors a long history of voter fraud. The suit, which will be heard in U.S. District Court, alleges the county violated all kinds of laws.

Then there’s Georgia, where an ongoing recount has already uncovered uncounted ballots in two counties. A flip in the results there will surely throw the election into a tailspin. Political commentator Bill O’Reilly says its more than likely that the suits, especially in Pennsylvania, will keep the United States Supreme Court busy in the next few weeks. But one problem lingers, he says. If SCOTUS grants the stay in Pennsylvania, it will trigger street violence like we’ve never seen. “The court knows that and the authorities know that, therefore that is a factor in these rulings,” he says. “Maybe it shouldn’t be, because the Constitution doesn’t say that if there’s going to be violence, you shouldn’t rule the proper way. Cruz: SCOTUS Not His Desire

Ted Cruz was among a second wave of names added to President Trump’s short list of potential Supreme Court nominees, but the Texas senator doesn’t see himself on the highest bench in the land anytime soon.

Cruz, who recently authored the book, One Vote Away, analyzing the most important SCOTUS decisions of our lifetime, says there’s nothing more important long-term than preserving the Constitution and the Bill of Rights, but added that he would decline a nomination from the President. “I’m glad that the President has the confidence in me, but that’s not the desire in my heart. I want to be in the political fight.”

And in the fight he is, proclaiming in the book that the thought of activist judges controlling the Supreme Court would gravely damage our basic civil liberties. “We got to stop rolling the dice with our Constitutional liberties,” he says. Federal Vs. State Powers

President Trump sent a tremor through the Democrat Party and the lamestream media earlier this week when he claimed absolute authority for opening the states for business. Though he has since backed down from the statement and taken a more conciliatory approach, the media attacks have been relentless. The debate of federal versus state power can be complicated. In the case of the Covid-19 pandemic, if the virus was relegated to a single state, the governor obviously would have the power to make decisions. Unfortunately, viruses know no boundaries. If the pandemic was nationwide, as we are now experiencing, the president has absolute power. Contrary to popular, left-wing belief, Trump is not a power-hungry tyrant. He has continuously shown the propensity to work with state governors. “And that’s the way it should be,” says legendary Constitutional lawyer Alan Dershowitz. “You should have open, cooperative federalism and nobody should be able to use this pandemic to their partisan, politcal advantage.” Dershowitz further breaks down federal versus state powers on the Larry King Show.
